1. Acceptance of Terms

By accessing the website pearldigitalmarketing.com or engaging our digital marketing services, you (“Client”) agree to be bound by these Terms & Conditions. If you do not agree, do not use our website or services.

2. Quote Request & Proposal Process

2.1 Requesting a Quote

Clients may request a quote by submitting a “Request a Proposal” form on our website or by contacting us directly via email or phone. You must provide accurate and complete information about your business, goals, and requirements.

2.2 Our Response Time

We will respond to your quote request within 24 hours of submission (excluding weekends and public holidays). Our response will include a detailed proposal, scope of work, timeline, and total cost.

2.3 Quote Validity Period

Each quote is valid for 72 hours from the time it is sent to you. The quote expiry time and date will be clearly stated in the proposal email.

3. Payment Terms

3.1 Payment Window

To accept a quote and secure our services, you must pay the full amount/half payment or agreed deposit within 72 hours of receiving the quote. Payment methods accepted: Bank Transfer, Credit Card.

3.2 What Happens After 72 Hours

If payment is not received within 72 hours, the quote expires automatically. Expired quotes are void and no longer honored. To proceed with services after the 72-hour window, you must request a new quote. The new quote may differ in price, scope, or timeline based on current market conditions and availability.

3.3 No Automatic Extensions

We do not grant automatic extensions to the 72-hour payment window. If you need more time, you must request a new quote after expiration.

4. Refund Policy

4.1 General Rule: No Refunds on Services Rendered

Due to the nature of digital marketing services (including strategy, labor, AI tools, and third-party ad spend), we do not offer refunds for work already performed or campaigns already launched.

4.2 Refund Eligibility (Limited Circumstances)

Refunds are only considered in the following cases:

Project is canceled by you before any work has begun 90% refund (10% processing fee retained)

Dissatisfaction with results (e.g., SEO rankings, ad performance) No refund – results vary and are not guaranteed

4.3 Non-Refundable Items

The following are never refundable:

  • Third-party ad spend (Google Ads, TikTok Ads, Facebook Ads, etc.)
  • Software or tool subscription fees paid on your behalf
  • Setup fees or one-time onboarding fees
  • Any work already delivered (reports, audits, content created, etc.)

4.4 How to Request a Refund

To request a refund, email us at sales@pearldigitalmarketing.com within 7 days of the triggering event. Approved refunds are processed within 14 business days.

5. Client Responsibilities

To receive our services, you agree to:

  • Provide timely access to any accounts, data, or information we reasonably request.
  • Respond to our communications within 48 hours to avoid project delays.
  • Ensure you have the legal right to use any assets (logos, images, content) you provide to us.
⚠️ Important: Delays caused by you may result in project timeline adjustments. We are not liable for missed deadlines caused by your failure to cooperate.

6. Intellectual Property

6.1 What Belongs to You

Your original brand assets (logos, product images, existing content) remain your property.

6.2 What Belongs to Us

Our proprietary strategies, AI models, reporting dashboards, and internal tools remain our confidential property.

6.3 Deliverables

Upon full payment, final deliverables (e.g., ad copies, SEO reports, strategy documents) are licensed to you for your internal business use. They may not be resold or redistributed.

7. Limitation of Liability

To the maximum extent permitted by law:

  • We do not guarantee specific results (e.g., #1 rankings, exact sales numbers, ROI percentages).
  • Our total liability to you for any claim arising from our services shall not exceed the total amount you paid us in the prior 3 months.
  • We are not liable for:
    • Changes in search engine algorithms
    • Suspension of your social media or ad accounts by third-party platforms (Google, TikTok, Meta, etc.)
    • Loss of revenue, profits, or data

8. Cancellation & Termination

8.1 By You

You may cancel ongoing services with 30 days written notice. No refunds for partial months or unused portions of prepaid campaigns.

8.2 By Us

We may terminate services immediately if you:

  • Fail to pay invoices on time
  • Provide false or illegal information
  • Harass our team members
  • Use our services for illegal activities

9. Force Majeure

We are not liable for delays or failures caused by events outside our reasonable control, including but not limited to: natural disasters, war, internet outages, platform failures (Google, Meta, TikTok), or government actions.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Lahore-Pakistan.

Any dispute shall first be attempted to be resolved through good-faith negotiation within 30 days. If unresolved, disputes shall be resolved through binding arbitration in Lahore-Pakistan, not in court.

11. Changes to These Terms

We may update these Terms & Conditions at any time. Continued use of our services after changes constitutes acceptance. Material changes will be notified via email.
